Profile


A Lawyer graduated from the Universidad Católica Andrés Bello (Law Degree, 1988), with a Specialization Degree in Labor Law (1991) and a PhD in Law (2016) from the same university. Numbered Individual of the Venezuelan Academy of Political and Social Sciences.

His professional career began in 1989 working as a lawyer in the Legal Department of Maraven (oil industry), where he participated in negotiations of two collective labor agreements. In 1993 he joins as an associate in the law firm Araque, Reyna, De Jesús, Sosa, Viso & Pitier until 1994; and subsequently from 1995 to 1997. From 1995 until 1996, he provided legal counseling to the Ministry of Education in the subject of collective labor relationships, and from 1997 to 1999 he served as General Director of the Ministry of Labor, where he had also served as Legal Consultant in years 1994 and 1995. Between 1996 and 1997 he was Deputy President of the Arbitration board of Sidor; from March 1997 to November 1998 he participated in the National Tripartite Commission; in 1997 he participated as co-drafter of the Amendment Project of the Organic Labor Law, and coordinated the Drafting Commission of the Regulations of said law in 1999. During 2001, he participated in several arbitration boards for the resolution of certain cases, among them Sidor-Sutiss; Cámara Nacional de la Construcción- Fetraconstrucción; Edelca-Sindicato; Ormesa-Sutrasalud Bolívar. Furthermore, he was a member of the evaluation jury of the Venezuelan Judiciary in 2000. He was an associate judge in the Fifth Court of Labor Matters of the Judicial Circuit of the Metropolitan Area of Caracas between 1994 and 1995. In 1999 he joins the law firm Torres, Plaz y Araujo as a Partner of the Labor Department until 2005.

His professional practice concentrates on providing permanent legal advice to companies from the sectors of foods and beverages, healthcare and pharmaceutical industry, as well as corporations from the tourism sector, in the fields of compensation, personnel management, prevention, conditions and work environment, and outsourcing. He also advises clients in negotiating with unions during collective agreements and labor conflicts. Among his principal clients are the conglomerate of Empresas Polar (Alimentos Polar, Cervecería Polar, Pepsi-Cola de Venezuela, Productos Efe, etc.), Centro Médico de Caracas, Policlínica Metropolitana, Laboratorios La Santé, Hotel Pestana, Hotel Altamira Suites, etc.

He is currently the Head Professor of the Social Law Department and of the course Collective Labor Law at the Universidad Católica Andrés Bello.

He is the author of several books, articles, essays and publications; the more recent are: “Tercerización Laboral” (2017), “Recomendación 198 OIT sobre la relación de trabajo” (2016), “Relación de trabajo: la técnica del test de laboralidad” (2016), “Derechos fundamentales del trabajador y libertad de empresa” (2014), “Ley Orgánica del Trabajo, los Trabajadores y las Trabajadoras y su Reglamento Parcial sobre el Tiempo de Trabajo” (2013), and “Libertad sindical: la perspectiva de los derechos fundamentales” (2012).
